In Texas, felonies are designated as capital felonies; first, second or third degree felonies; or state jail felonies.

Capital felonies are punishable by death or life in prison without parole.

First degree felonies are punishable by life imprisonment or five to 99 years in prison, and a fine up to $10,000.

Second degree felonies are punishable by two to 20 years in prison, and a fine up to $10,000.

Third degree felonies are punishable by two to 10 years in prison, and a fine of up to $10,000.

State jail felonies are punishable by 180 days to two years in state jail, and a fine of up to $10,000.
