Guardianship

Often family members and other loved ones reach a point where they can no longer make decisions on their own, whether due to age, illness or disabilitiy. As they require the assistance of another person, guardianships provide family members the ability to make the important decisions and actions on their behalf.

Before you reach a point where you are no longer able to make decisions for yourself, you may want to choose a guardian to provide the financial support and personal care you require. There are two types of guardians in the State of Texas – Guardian of the Person and Guardian of the Estate.

Guardians of the Person are appointed to make decisions related to the well being and care of a person, with responsibilities that include:
  • Making medical decisions
  • Arranging medical care for the ward
  • Providing for the care, supervision and protection of the ward
  • Arranging for the placement of the ward in long-term facilities or hospitals
Guardian of the Estate are appointed to make decisions related to the ward’s finances. The Guardian of the Estate responsibilities include:
  • Taking possession of the ward’s assets
  • Enforcing legal obligations owed to the ward
  • Defending the ward in legal actions
  • Making decisions related to the management and investment of assets
  • Collecting rents, claims and debts owed to the ward
